What is the FFCRA?

The Family First Coronavirus Response Act (FFCRA) enacted in 2020 mandated emergency paid sick leave and expanded family and medical leave for COVID-19-related reasons. It required certain employers to provide employees with paid sick leave or expanded family and medical leave for specific virus-related circumstances. This included caring for themselves, someone affected by the virus, or for children whose schools or childcare providers were closed due to COVID-19. The FFCRA aimed to alleviate the economic strain on workers while ensuring they could take necessary leave without losing pay, offering tax credits to employers to offset the costs of providing these benefits.

Is there a limit on the pay an employee can receive during FFCRA leave?

 Yes, paid sick leave is capped at certain amounts per day based on the reason for leave, while expanded family and medical leave has a maximum total pay limit.

Employees can receive up to 40 hours of paid leave under the FFCRA.

 Eligible full-time employees can receive up to 80 hours of paid sick leave, while those caring for others or experiencing school closures can receive up to 12 weeks of expanded family and medical leave.

Who is eligible?

Under the FFCRA, eligibility generally applies to employees working for private businesses with fewer than 500 employees. Gardeners employed by such businesses may qualify for benefits provided they meet the other criteria outlined in the FFCRA.
